Land Remediation Relief was introduced to address the inherent market challenges associated with the restoration and redevelopment of land that had fallen into disrepair or had been contaminated due to prior industrial use by third parties.
This tax relief opportunity extends its benefits to corporations subject to corporate tax across various property sectors, encompassing domestic and commercial properties alike. This includes property investors and developers actively engaged in these sectors.
Eligible costs under this scheme encompass a wide range of activities, such as remediating contaminated land, asbestos removal from structures, excavation of buried elements, and the treatment of hazardous organisms and naturally occurring contaminants like Japanese Knotweed, Radon, and Arsenic.
Land Remediation Relief applies to both capital and revenue expenditures. To make use of this relief, the company is required to make an election within two years of the accounting period in which the qualifying expenses were incurred, allowing them to offset these costs as deductions against their taxable profits.

Tax Credit
In cases where the eligible company experiences a financial loss during the accounting period in which it invests in remediating contaminated or abandoned land, it has the option to request a payable credit.
This credit is equivalent to 16% of the Land Remediation Relief (LRR) claim as determined by HMRC. To put it in perspective, this amounts to 24%of the actual expenses incurred (calculated as 16% divided by 150%).
